These Terms of Use ("Terms") govern your access to and use of HolyardProductions.com and related Holyard Productions digital content, pages, editorial features, artist pages, media pages, submission experiences, and website services (collectively, the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply to the main Holyard Productions website. If you purchase products through our Shopify-powered shop, additional store policies, checkout terms, shipping terms, refund policies, or privacy terms may apply to those purchases.

1. Changes to These Terms

We may revise these Terms from time to time in our sole discretion. Changes become effective when posted. Your continued use of the Site after updated Terms are posted means you accept the revised Terms.

2. Eligibility

You may use the Site only if you can legally agree to these Terms under applicable law. If you are under the age of 18, you should use the Site with the involvement, supervision, or consent of a parent or legal guardian where required by law.

3. Ownership and Intellectual Property

The Site and its content, including but not limited to text, articles, graphics, logos, layouts, branding, artwork, images, videos, audio, designs, editorial concepts, metadata, and overall presentation, are owned by or licensed to Holyard Productions unless otherwise stated and are protected by intellectual property and other applicable laws.

You may not reproduce, republish, distribute, modify, create derivative works from, scrape, frame, mirror, reverse engineer, or commercially exploit any part of the Site without prior written permission, except as allowed by applicable law.

4. Permitted Use

You may use the Site for lawful, personal, and non-commercial purposes only. You agree not to use the Site in any way that:

• violates any law or regulation;
• infringes the rights of Holyard Productions or any third party;
• harms, disables, overburdens, or impairs the Site;
• attempts unauthorized access to any part of the Site, server, database, or connected system;
• uses bots, scraping tools, scripts, or automated systems to extract data or content without permission;
• transmits spam, malicious code, or harmful material;
• misrepresents your identity or affiliation.

5. Submissions and Communications

If you submit music, media, press materials, messages, or other content to Holyard Productions, you represent that you have the right to send that material and that doing so does not violate any law or third-party rights.

By submitting content or communications, you grant Holyard Productions a non-exclusive right to review, store, and use the submission for evaluation, communication, editorial consideration, internal review, and related business purposes, subject to any separate written agreement if one exists.

6. Newsletter and Promotional Communications

If you sign up for our newsletter or marketing communications, you agree to receive emails or related communications from Holyard Productions until you unsubscribe. You may opt out at any time.

7. Third-Party Links and Services

The Site may contain links to third-party websites, platforms, social media services, streaming platforms, embedded media, and external stores. These links are provided for convenience only. Holyard Productions does not control and is not responsible for third-party content, policies, services, or actions.

8. Shopify Shop and Store Policies

Certain products or merchandise may be offered through a Shopify-powered shop or related e-commerce system. Purchases made through the shop may be subject to separate policies, including privacy, shipping, refund, or checkout terms presented through the store experience. Those policies are in addition to these Terms where applicable.

9. Disclaimer

The Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

Holyard Productions does not guarantee that the Site will always be available, secure, error-free, or free from viruses or harmful components. You are responsible for using appropriate safeguards when accessing the internet and digital content.

10. Limitation of Liability

To the fullest extent permitted by law, Holyard Productions and its affiliates, collaborators, licensors, service providers, team members, contractors, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Site.

To the fullest extent permitted by law, Holyard Productions' total liability for any claim arising out of or relating to the Site or these Terms shall not exceed the greater of the amount you paid to Holyard Productions for the specific service giving rise to the claim, or fifty U.S. dollars (US $50), if applicable.

11. Indemnification

You agree to defend, indemnify, and hold harmless Holyard Productions and its affiliates, collaborators, licensors, service providers, officers, directors, employees, contractors, agents, and representatives from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your violation of these Terms or your misuse of the Site.

12. Termination

We may suspend, restrict, or terminate your access to all or part of the Site at any time, with or without notice, if we believe you have violated these Terms or if we determine it is necessary to protect the Site, our users, or our business.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of laws principles.

14. Disputes

Any dispute arising out of or relating to these Terms or the Site shall be resolved in the courts located in Israel, unless applicable law requires otherwise or unless the parties agree to another method of dispute resolution.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

16. Waiver

No waiver of any term or condition in these Terms shall be deemed a continuing waiver of that term or of any other term.
